Terms and Conditions
Last updated: 27 April 2026
Please read these Terms and Conditions carefully before using CheckSpent. By accessing or using any part of our service, you agree to be bound by these terms. These terms are governed by Australian law, including the Competition and Consumer Act 2010 (Cth) and the Australian Consumer Law (ACL). Nothing in these terms excludes, restricts, or modifies any rights you have under the ACL that cannot be lawfully excluded.
1. Acceptance of Terms
By accessing checkspent.com or using any CheckSpent product or service, you confirm that you are at least 18 years old (or have the consent of a parent or legal guardian) and that you agree to these Terms and Conditions and our Privacy Policy. If you do not agree, do not use the service.
For paid products: Before completing any purchase, you must actively confirm that you have read and agree to these Terms and Conditions, our Privacy Policy, and our Disclaimer by selecting the required checkbox at checkout. No purchase can proceed without this confirmation.
2. Services Offered
CheckSpent provides the following services:
Free 2-minute subscription estimate
A short questionnaire that estimates your potential monthly subscription spend. This is provided free of charge and does not require account creation. Results are estimates only and are not based on your actual bank data.
Subscription report (paid — $54 USD)
An AI-generated report produced by uploading your bank statement (PDF, CSV, or screenshot). This is a paid service. The report is for informational and educational purposes only. It does not constitute financial advice.
Cancellation email templates (paid — $19.95 USD)
A pack of ready-to-use email templates for cancelling subscriptions, requesting refunds, and negotiating lower rates. Templates are general-purpose documents for personal use only and do not constitute legal advice.
Pricing and currency: All prices on checkspent.com are displayed and charged in United States Dollars (USD) unless otherwise indicated at the time of checkout. CheckSpent operates from Australia and reserves the right to change the currency of pricing in future. Any change in currency applies to future purchases only and will be clearly displayed at checkout. You are solely responsible for any currency conversion fees, foreign transaction charges, or exchange rate differences applied by your bank, card issuer, or payment provider. The amount debited from your account in your local currency may differ from the displayed USD price due to exchange rate fluctuations and provider fees.
3. Not Financial Advice — No Professional Relationship
⚠️ CheckSpent does not hold an Australian Financial Services Licence (AFSL) and is not authorised to provide financial product advice under the Corporations Act 2001 (Cth). We do not provide “personal advice” or “general advice” as those terms are defined in section 766B of the Corporations Act 2001 (Cth). Nothing on this website — including any subscription analysis report, template, the website content, social media posts, emails, or any other materials we publish — constitutes financial advice, investment advice, tax advice, legal advice, or any other regulated professional service. Our content does not contain recommendations to acquire, hold, or dispose of any financial product, security, or investment. You should consult a licensed financial adviser, accountant, or other relevant professional before making financial decisions.
No professional relationship: Your use of CheckSpent — including the purchase and use of any product or service — does not create a financial adviser–client relationship, a fiduciary relationship, a legal adviser–client relationship, or any other professional or regulated relationship between you and CheckSpent. You acknowledge and agree that all decisions you make based on information provided by CheckSpent are your own.
4. Use of the Service
By using CheckSpent, you agree to:
- Use the service only for lawful purposes and in accordance with these terms.
- Upload only bank statements or transaction data that you are authorised to share.
- Not attempt to reverse-engineer, scrape, or disrupt the platform.
- Not use the service to process data belonging to another person without their explicit written consent.
- Not attempt to circumvent any payment gate or access paid features without purchase.
- Not use any content, report, or template for commercial resale or redistribution.
5. User Indemnification
You agree to indemnify, defend, and hold harmless CheckSpent, its owners, directors, employees, contractors, and agents from and against any and all claims, losses, damages, liabilities, costs, and expenses (including reasonable legal fees) arising from or related to:
- Your use or misuse of the service.
- Your breach of these Terms and Conditions.
- Your upload of bank statement data belonging to another person without their consent.
- Any action you take (or fail to take) based on information provided by CheckSpent.
- Any third-party claim arising from your use of templates, including cancellation letters, refund requests, or negotiation scripts.
This indemnification obligation survives the termination of your use of the service.
6. Payments, Refunds, and Consumer Guarantees
Paid products are billed in the currency displayed at checkout. Payment must be made in full before access is granted. All payments are processed by third-party payment providers (such as Stripe). CheckSpent does not store full credit card numbers or payment credentials.
Checkout consent requirement: You must confirm that you have read and agree to these Terms and Conditions, our Privacy Policy, and our Disclaimer before completing any purchase. This confirmation is recorded and forms part of our agreement with you.
GST and VAT: CheckSpent is registered for Australian Goods and Services Tax (GST) under ABN 44 692 416 783. To minimise friction at checkout, we display a single flat price to all customers worldwide and do not add tax on top at checkout. For sales to Australian consumers, the displayed price is treated as GST-inclusive and CheckSpent remits the applicable GST portion directly to the Australian Taxation Office. For consumers outside Australia, the displayed price is the total amount payable and no additional consumption tax (such as VAT or digital services tax) is collected by us. You may be responsible for any taxes, duties, or levies imposed by your local jurisdiction independently of this transaction. If you require a GST tax invoice for an Australian purchase, please request it via our contact form and we will issue one.
Australian Consumer Law guarantees: Under the ACL, consumers have non-excludable guarantees in relation to goods and services. If a product or service fails to meet a consumer guarantee, you may be entitled to a remedy (repair, replacement, refund, or compensation). These rights cannot be excluded and apply regardless of any other term in this agreement.
Digital products (templates, subscription reports): Our products are digital goods delivered instantly upon purchase. By completing checkout, you expressly acknowledge and consent to immediate delivery and agree that, where permitted by applicable law, you waive any statutory cooling-off or withdrawal right that would otherwise apply. This waiver does not affect any rights you have under the ACL or other mandatory consumer protection laws that cannot be excluded, including the right to a remedy where a product is defective or fails to match its description.
Refund policy: Refunds are available in the following circumstances: (a) your uploaded file cannot be processed due to a technical error on our part — contact us within 14 days of purchase; (b) the product is materially defective or does not match its description; or (c) a non-excludable consumer guarantee under the ACL applies. Refunds are not available where you have simply changed your mind, where you have already accessed or downloaded the product, or where the product has been delivered as described.
6a. EU and UK Right of Withdrawal
For consumers in the European Economic Area (EEA) and the United Kingdom: Under EU Directive 2011/83/EU and the UK Consumer Contracts (Information, Cancellation and Additional Charges) Regulations 2013, you ordinarily have a 14-day right to withdraw from a contract for digital content without giving a reason. However, you lose this right if performance of the contract has begun with your express consent and your acknowledgement that you thereby lose your right of withdrawal.
By completing your purchase of a digital product (subscription report or cancellation templates), you expressly request immediate delivery and acknowledge that you lose your right of withdrawal once delivery has commenced. A checkbox confirming this is presented at checkout and the consent is recorded by our payment processor.
If delivery has not yet commenced, EU/UK consumers may withdraw within 14 days by contacting us and stating their intention to withdraw. Upon a valid withdrawal, we will refund all amounts paid within 14 days using the same payment method used for the original transaction.
7. Accuracy and Limitations
CheckSpent uses AI to extract and classify transactions. While we work to maximise accuracy, the system may produce false positives (incorrectly identified subscriptions), false negatives (missed subscriptions), or incorrect amounts — particularly for image uploads or non-standard bank formats. Results should be verified against your actual bank records before taking action.
Estimates shown — including monthly spend totals, annual projections, and savings potential — are based on detected patterns and known subscription data. They are indicative only and may not reflect your true financial position.
8. Intellectual Property
All content, branding, software, algorithms, and materials on checkspent.com are owned by CheckSpent or its licensors and are protected by Australian and international intellectual property laws. You may not copy, reproduce, distribute, modify, or create derivative works without our prior written consent. Templates purchased as part of a paid product are licensed for personal use only and may not be resold, redistributed, sublicensed, or used for commercial purposes.
9. Referral Link Disclosure
Some links on CheckSpent may be referral links. Where this is the case, it will be noted clearly. If you click a link and sign up or make a purchase, CheckSpent may receive a commission or referral bonus at no additional cost to you. This does not influence which services are listed or how they are described. All material connections are disclosed in compliance with ACCC guidance on endorsements and testimonials. Referral offers are subject to the terms and conditions of the respective third-party providers and may change or expire at any time without notice.
10. Third-Party Services and Links
CheckSpent may link to third-party websites or services (banks, subscription providers, etc.). We are not responsible for the content, accuracy, privacy practices, or terms of any third party. Links are provided for convenience only and do not constitute endorsement unless explicitly stated.
11. Limitation of Liability
To the maximum extent permitted by law (and subject to any non-excludable rights under the ACL), CheckSpent is not liable for:
- Any indirect, incidental, special, consequential, or punitive losses.
- Financial loss arising from reliance on subscription reports, estimates, or templates.
- Errors, inaccuracies, or omissions in AI-generated analyses.
- Loss of data, reports, or access due to technical failures.
- Actions taken (or not taken) by third-party subscription providers in response to templates.
- Currency conversion fees, foreign transaction charges, or exchange rate differences.
Where our liability cannot be excluded under the ACL, our liability is limited to the lesser of: (a) resupply of the service; or (b) refund of the amount paid for the specific product or service giving rise to the claim.
Aggregate cap: In no event shall CheckSpent's aggregate liability arising from or related to your use of the service exceed the amount paid by you for the specific product giving rise to the claim. For free or low-value services where no payment was made, our aggregate liability is capped at one hundred Australian dollars (AUD 100).
Time limit on claims: Any claim arising out of or in connection with these Terms or your use of the service must be brought within twelve (12) months from the date the cause of action arose. Claims brought after this period are barred to the maximum extent permitted by law.
No income, savings, or outcome claims: CheckSpent makes no representation or warranty that any user will achieve any specific financial result, savings amount, income outcome, or other outcome from using our content or reports. Examples, case studies, illustrative figures (such as “save $500/year”), or hypothetical scenarios in our materials are for explanatory purposes only and are not typical results. Individual outcomes vary based on personal circumstances, behaviour, market conditions, and many other factors outside our control.
User-generated content: CheckSpent does not currently host comments, reviews, forums, or other user-generated content (UGC) on the website. If we add such functionality in the future, any opinions, claims, or representations made by users will be those of the individual user only and not of CheckSpent. We do not endorse, verify, or assume responsibility for any UGC and reserve the right to remove any UGC at our sole discretion.
12. Dispute Resolution
Before initiating formal proceedings, you agree to contact us to attempt informal resolution. We will endeavour to respond within 14 days. If informal resolution is unsuccessful within 30 days, either party may pursue formal remedies.
Individual claims only (no class actions): To the maximum extent permitted by applicable law, all claims and disputes between you and CheckSpent must be brought on an individual basis only. You agree not to participate in any class action, collective action, mass action, representative action, or consolidated proceeding against CheckSpent. This waiver does not apply where prohibited by Australian law (including the Australian Consumer Law) or by other mandatory consumer protection legislation that cannot be excluded by agreement.
13. Service Availability
CheckSpent is provided on an “as is” and “as available” basis. We do not guarantee uninterrupted access. We may modify, suspend, or discontinue any feature at any time with or without notice, subject to any applicable consumer guarantees under the ACL.
Force majeure: CheckSpent will not be liable for any failure or delay in performance arising from causes beyond our reasonable control, including but not limited to acts of God, natural disasters, pandemics, war, terrorism, civil unrest, government action or regulation, internet or telecommunications outages, cyberattacks, power failures, or failures of third-party service providers (including hosting, payment, or email providers). We will use reasonable efforts to resume service as soon as practicable.
13a. Investment Risk Warning
CheckSpent does not provide advice on investments, securities, or financial products. Any decisions to change your spending, redirect savings toward investments, or make financial product decisions based on information from CheckSpent are made entirely at your own risk. Past subscription patterns are not indicative of future financial outcomes. Investments involve risk, including the possible loss of principal. You should seek advice from a licensed financial professional before making any investment decisions.
13b. Termination
CheckSpent reserves the right to suspend or terminate your access to the service at any time, with or without notice, if we reasonably believe you have breached these Terms and Conditions, engaged in fraudulent or abusive conduct, or if we are required to do so by law. Where termination is due to your breach, no refund will be payable. Where termination is initiated by us without cause, we will refund any amounts paid for products or services not yet delivered.
You may stop using the service at any time. Termination of access does not affect any rights or obligations that have already arisen, including payment obligations for products already delivered.
14. Jurisdiction and Governing Law
These terms are governed by the laws of the State of New South Wales, Australia. Any dispute arising from or related to these terms or the use of CheckSpent will be subject to the exclusive jurisdiction of the courts of New South Wales and the federal courts of Australia.
International users: If you access CheckSpent from outside Australia, you do so at your own initiative and are responsible for compliance with local laws in your jurisdiction. By using the service, you agree that these terms are governed by Australian law and you submit to the jurisdiction of Australian courts. Nothing in these terms limits any rights you may have under the mandatory consumer protection laws of your own jurisdiction that cannot be excluded by agreement.
15. Severability
If any provision of these Terms and Conditions is found to be invalid, illegal, or unenforceable by a court of competent jurisdiction, that provision will be severed from these terms and the remaining provisions will continue in full force and effect.
16. Entire Agreement
These Terms and Conditions, together with the Privacy Policy and Disclaimer, constitute the entire agreement between you and CheckSpent regarding your use of the service. They supersede all prior agreements, representations, and understandings.
16a. Survival
The following sections survive termination or expiry of these Terms and Conditions and your use of the service: Section 3 (Not Financial Advice), Section 5 (User Indemnification), Section 8 (Intellectual Property), Section 11 (Limitation of Liability), Section 12 (Dispute Resolution), Section 13a (Investment Risk Warning), Section 13b (Termination), Section 14 (Jurisdiction and Governing Law), Section 15 (Severability), Section 16 (Entire Agreement), and this Section 16a. Any obligation that by its nature should survive termination will continue in full force and effect.
17. Changes to These Terms
We may update these Terms from time to time. Material changes will be notified by updating the “Last updated” date on this page. Where a change materially affects your rights or obligations, we will provide at least 14 days' prior notice before the change takes effect (for example, by email if you have provided one, or by prominent notice on the website). Your continued use of the service after the effective date of any change constitutes acceptance of the revised terms. If you do not agree with a material change, you should stop using the service before the change takes effect.
EU and UK consumers — right to reject changes: If you are a consumer located in the EEA or the United Kingdom and we make a material change to these Terms that is to your detriment, you have the right to reject the change and terminate the contract before the change takes effect, without penalty. To reject a change, contact us before the effective date of the change. Any products already delivered and paid for prior to termination will not be subject to a refund solely on the basis of a rejected change.
18. Contact
For questions about these Terms, please use our contact form. We do not publish a direct email address to reduce phishing and spam risk; messages submitted through the contact form are routed to our support team.
19. Accessibility
CheckSpent is committed to making its website accessible to all users, including those with disabilities. We endeavour to maintain reasonable conformance with the Web Content Accessibility Guidelines (WCAG) 2.1 Level AA. If you experience difficulty accessing any part of our website or require content in an alternative format, contact us and we will make reasonable efforts to assist you. This commitment to accessibility does not create an independently enforceable obligation beyond what is required by applicable law.
